The law requires that personal data be processed lawfully, in good faith, and in a manner that is transparent to the data subject (“lawfulness, processing in good faith, transparency”). To ensure this, we provide you with the specific legal definitions used in this privacy policy:
“Personal data” means any information relating to an identified or identifiable natural person (hereinafter “data subject”); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person.
“Processing” means any operation or set of operations performed on personal data, whether or not by automated means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure, or destruction.

“Pseudonymization” means the processing of personal data in such a way that the personal data can no longer be attributed to a specific data subject without the use of additional information, provided that such additional information is kept separately and is subject to technical and organizational measures that ensure the personal data cannot be attributed to an identified or identifiable natural person.
“File system” means any structured collection of personal data that can be accessed according to specified criteria, regardless of whether such collection is maintained on a centralized, decentralized, functional, or geographic basis.
“Controller” means a natural or legal person, public authority, agency, or other body that, alone or jointly with others, determines the purposes and means of the processing of personal data; where the purposes and means of such processing are determined by Union or Member State law, the controller or the specific criteria for its designation may be provided for by Union or Member State law

However, public authorities that may receive personal data in the context of a specific investigative mandate under Union or Member State law shall not be considered recipients; the processing of such data by those authorities shall be carried out in accordance with applicable data protection rules, consistent with the purposes of the processing.
“Third party” means a natural or legal person, public authority, agency, or other body, other than the data subject, the controller, the processor, and the persons authorized to process the personal data under the direct responsibility of the controller or the processor.
“Consent” of the data subject means any freely given, specific, informed, and unambiguous indication of the data subject’s wishes, expressed by a statement or by a clear affirmative action, by which the data subject signifies his or her agreement to the processing of personal data relating to him or her.
Lawfulness of processing
The processing of personal data is lawful only if there is a legal basis for such processing. The legal basis for processing may be, in particular, Article 6(1)(a) through (f) of the GDPR:
Below, we provide information about the collection of personal data when using our website.
When users browse the website, PHYCOMANIA collects only the personal data that the user’s browser transmits to PHYCOMANIA’s server. When users view the PHYCOMANIA website, PHYCOMANIA collects the following data, which are technically necessary to display the website to users and to ensure its stability and security:
After a technical evaluation, this data is deleted immediately. In accordance with Article 6(1)(f) of the GDPR, this data collection serves to protect our legitimate interests in the proper presentation of our website, which, following a balancing of interests, outweigh our users’ interests, as well as to ensure compliance with the EU General Data Protection Regulation regarding security and confidentiality.
In addition to the data mentioned above, cookies or similar technologies such as pixels (hereinafter generally referred to as “cookies”) are used on your computer when you use and visit our website. Cookies are small text files that your browser stores on your device to save certain information, or image files, such as pixels. The next time you visit our website using the same device, the information stored in cookies is subsequently sent back either to our website (“first-party cookie”) or to another website to which the cookie belongs (“third-party cookie”).
Based on the stored and returned information, the website recognizes that you have previously accessed and visited it using the browser on your device. We use this information to optimize the design and display of the website according to your preferences. Only the cookie itself is stored on your device. Any further storage of personal data occurs only with your express consent or if it is absolutely necessary to enable you to use the service you have accessed.
This website uses the following types of cookies, the purpose and functionality of which are explained below:
We will let you know which types of cookies are set and used in each case for the tools we use.
(1) Cookies that are strictly necessary (type a)
Essential cookies ensure functions that are necessary for you to use our websites as intended. These cookies are used exclusively by us and are therefore first-party cookies. This means that all information stored in the cookies is sent back to our website.
Essential cookies are used, for example, to ensure that you, as a logged-in user, remain logged in when accessing various pages on our website, so you don’t have to re-enter your login credentials every time you visit a new page.
We may use strictly necessary cookies on our website without your consent. For this reason, strictly necessary cookies cannot be individually disabled or enabled. However, you can disable cookies in your browser at any time (see below).
The legal basis for this data processing is Article 6(1)(b) of the GDPR.
(2) Functional and performance cookies (type b)
Functional cookies allow our website to store information you have already provided (such as your registered name or language selection) and offer you improved and more personalized features based on that information. These cookies collect and store only anonymized information, so they cannot track your activity on other websites.
Performance cookies collect information about how our websites are used in order to improve their appeal, content, and functionality. These cookies help us determine, for example, whether and which subpages of our website are visited and which content users are particularly interested in. In particular, we record the number of times a page is accessed, the number of subpages accessed, the time spent on our website, the order of the pages visited, which search terms led you to us, the country, region, and, if applicable, the city from which access is made, as well as the proportion of mobile devices accessing our websites. Furthermore, we track movements, “clicks,” and scrolling with the computer mouse to understand which areas of our website are of particular interest to users. As a result, we can tailor the content of our website more specifically to the needs of our users and optimize our offering. The IP address of your computer, transmitted for technical reasons, is automatically anonymized and does not allow us to draw any conclusions about the individual user.
You can object to the use of functional and performance cookies at any time by adjusting your cookie settings accordingly.
The legal basis for this data processing is Article 6(1)(f) of the GDPR.
(3) Cookies requiring consent (type c)
Cookies that are neither essential (type A) nor functional or performance cookies (type B) are used only after you have given your consent.
We reserve the right to use information obtained through cookies from an anonymized analysis of visitor behavior on our websites to display targeted advertising for certain of our products to you on our own websites. We believe that you, as a user, benefit from this because we display advertising or content that we believe, based on your browsing behavior, aligns with your interests, thereby reducing the amount of randomly displayed advertising or content that may be of less interest to you.
Marketing cookies come from external advertising companies (third-party cookies) and are used to collect information about the websites the user visits in order to create targeted advertisements for the user.
Opt out of marketing cookies
You can also manage cookies used for online advertising through tools developed in many countries as part of self-regulatory programs, such as the U.S.-based https://www.aboutads.info/choices/ or the EU-based http://www.youronlinechoices.com/uk/your-ad-choices.
You can revoke your consent to cookies at any time with future effect here.
The legal basis for this data processing is Article 6(1)(a) of the GDPR.
(4) Managing and deleting all cookies
In addition, you can configure your web browser to generally prevent cookies from being stored on your device or to ask for your consent each time a cookie is set. Once cookies have been set, you can also delete them at any time. You can find detailed instructions on how this works in your browser’s help section.
Please note that disabling cookies may result in limited functionality on our website.
You can visit our website without providing any personal information. Each time you access our website, your internet browser transmits usage data to us or our web host/IT service provider, which is then stored in log files (so-called server log files). This stored data includes, for example, the name of the page accessed, the date and time of access, the IP address, the amount of data transferred, and the requesting provider.
This processing is carried out pursuant to Article 6(1)(f) of the GDPR based on a legitimate interest in ensuring the smooth operation of our website and in improving our services.
When you contact PHYCOMANIA by email or through the contact form, the information you provide (your email address, first name, and last name, if applicable) will be stored by PHYCOMANIA in order to respond to your inquiry. PHYCOMANIA deletes the data collected in this context once storage is no longer necessary, such as when your inquiry has been resolved. Otherwise, processing will be restricted if there are legal obligations to retain the data.
This data processing is carried out pursuant to Article 6(1)(a) of the GDPR based on the consent provided by the customers.
When placing an order for products, the following personal data is collected during the registration process required to complete the order:
1.title,
PHYCOMANIA uses this data exclusively for the purpose of fulfilling the contract and for communication with customers as necessary. This includes the initiation, conclusion, processing, warranty, and, if necessary, the termination of the contract. The data will be stored until the contract has been fully fulfilled. Where applicable commercial and tax retention periods apply, the storage period may be up to 10 years.
This data processing is based on Article 6(1)(b) of the GDPR for the performance of the contract. The legal basis for the continued storage of data for tax and commercial law purposes is the necessity required by law pursuant to Article 6(1)(c) of the GDPR.
PHYCOMANIA discloses customers’ personal data only to the extent necessary for the performance of the contract or to protect PHYCOMANIA’s legitimate interests. PHYCOMANIA uses external service providers (data processors) to fulfill the contract. Separate data processing agreements have been entered into with these service providers to ensure the protection of customers’ personal data.
To facilitate delivery, the customer’s first name, last name, address, email address, and phone number are provided to the shipping company. This data transfer is necessary to fulfill the contractual relationship with you as a customer. The legal basis for this data processing is Article 6(1)(b) of the GDPR.
For payment processing, the customer’s payment information—namely first name, last name, address, email address, and phone number—will be forwarded to the respective payment provider. This data processing is carried out for the purpose of fulfilling the contractual relationship with you as a customer or based on the consent you have provided. The legal basis for this data processing is Article 6(1)(a) or (b) of the GDPR.
PHYCOMANIA uses customers' personal data to send them a newsletter, if applicable, only if they have given their prior consent to such use.
The only required information for subscribing to the newsletter is your email address. Providing any additional, separately marked information is optional and is used to address you personally. Once you have confirmed your subscription, PHYCOMANIA will store your email address for the purpose of sending you the newsletter.
The customer may withdraw consent to receive the newsletter at any time and unsubscribe from the newsletter. The customer may withdraw consent by clicking on the link provided in every newsletter email or by sending an email tosupport@phycomania.com
PHYCOMANIA analyzes user behavior when sending the newsletter. For this analysis, the emails sent contain so-called web beacons or tracking pixels, which are single-pixel image files stored on the PHYCOMANIA website. For the analysis, the data provided by users and the web beacons are linked to the user’s email address and a unique ID. The data is collected exclusively in pseudonymous form, i.e., the IDs are not linked to the user’s other personal data, and direct personal identification is excluded. The user may object to this tracking at any time by clicking on the separate link provided in each email or by notifying PHYCOMANIA via another contact channel. The information will be stored for as long as the user subscribes to the newsletter. After unsubscribing, PHYCOMANIA stores the data purely for statistical purposes and anonymously.
This data processing is based on the consent provided by the customer; the legal basis is Article 6(1)(a) of the GDPR.
We use social media plugins (hereinafter: plugins) from the following providers:
We use what is known as the two-click solution. This means that when you visit our site, no personal data is initially transmitted to the providers of the plug-ins. You can identify the plug-in provider by the icon next to its initial letter or logo. We provide you with the option to communicate directly with the plug-in provider via the button. Only if you click on the icon and thereby activate it will the plug-in provider receive the information that you have accessed the corresponding page of our website. By activating the plug-in, your personal data is transmitted to the respective plug-in provider and stored there (in the case of U.S. providers, in the U.S.). Since the plug-in provider collects the data primarily via cookies, we recommend that you delete all cookies via your browser’s security settings before clicking on the grayed-out box.
We have no control over the data collected or the data processing operations, nor are we aware of the full scope of data collection, the purposes of processing, or the retention periods. We also have no information regarding the deletion of the collected data by the plugin provider.
The plug-in provider stores the data collected about you as usage profiles and uses them for advertising, market research, and/or to tailor the design of its website to user preferences. This analysis is conducted in particular (even for users who are not logged in) to display personalized advertising and to inform other users of the social network about your activities on our website. You have the right to object to the creation of these user profiles; to exercise this right, you must contact the respective plug-in provider. Through the plug-ins, we offer you the opportunity to interact with the social networks and other users so that we can improve our service and make it more interesting for you as a user.
Data is transferred regardless of whether you have an account with the plugin provider and are logged in there. If you are logged in to the plugin provider, the data we collect is directly associated with your account with the plugin provider. If you click the activated button and visit the page, for example, the plugin provider also saves this information in your user account and shares it publicly with your contacts. We recommend that you log out regularly after using a social network, but especially before clicking the button, as this allows you to prevent the data from being linked to your profile with the plug-in provider.
For more information on the purpose and scope of data collection and processing by the plug-in provider, please refer to the privacy policies of these providers, which are provided below. There you will also find further information about your rights in this regard and settings to protect your privacy:
This data processing is based on Article 6(1)(a) of the GDPR, based on the consent you have provided, and on Article 6(1)(f) of the GDPR to protect the legitimate interests of PHYCOMANIA, namely the optimization of our services.
On our website, we have integrated various tools from different companies that allow us to analyze your user behavior or provide links to other websites. To this end, we have entered into separate data processing agreements with the companies listed below to ensure the protection of your personal data.
We work with the following service providers:
Use of Google Analytics
This website uses Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics uses “cookies,” which are text files placed on your computer, to help the website analyze how users use the site. The information generated by the cookie regarding your use of this website is typically transmitted to a Google server in the United States and stored there. However, if IP anonymization is enabled on this website, your IP address will be truncated by Google within member states of the European Union or in other signatory states to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the United States and shortened there. On behalf of the operator of this website, Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity, and providing other services relating to website activity and internet usage to the website operator.
The IP address transmitted by your browser as part of Google Analytics is not combined with other data from Google.
You can refuse the use of cookies by selecting the appropriate settings in your browser; however, please note that if you do so, you may not be able to use all the features of this website. You can also prevent the collection of data generated by the cookie and related to your use of the website (including your IP address) by Google, as well as the processing of this data by Google, by downloading and installing the browser plug-in available at the following link: http://tools.google.com/dlpage/gaoptout?hl=pt.
This website uses Google Analytics with the “anonymizeIp()” extension. This means that IP addresses are processed in abbreviated form, thereby preventing any personal identification. If the data collected about you contains any personal information, it is immediately excluded, and the personal data is deleted immediately.
We use Google Analytics to analyze and continuously improve the user experience on our website. The statistics we collect help us enhance our services and make them more appealing to you as a user. In the rare instances where personal data is transferred to the United States, Google complies with the EU-U.S. Privacy Shield, https://www.privacyshield.gov/EU-US-Framework.

PHYCOMANIA uses the technical platform and services of Facebook Ireland Ltd, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland (“Facebook”) for the information service provided here.
According to the ECJ, Facebook and the operator of a Facebook fan page share joint responsibility, within the meaning of Article 26 of the GDPR, for the personal data processed via the Facebook fan page. For this reason, Facebook and PHYCOMANIA have entered into a joint responsibility agreement, which you can access here.
PHYCOMANIA provides the following information regarding data processing on our Facebook Fan Page:

The processing of your personal data on the PHYCOMANIA Facebook page is carried out under joint responsibility with:
Facebook Ireland Ltd, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland
(2) Data processing
When you visit a Facebook fan page, the IP address of your device is transmitted to Facebook. According to Facebook, this IP address is anonymized and deleted after 90 days, at least if it is a German IP address. In addition, Facebook stores further information about its users’ devices, such as the web browser used. If necessary, Facebook is thus able to link IP addresses to individual users. If you are logged into your Facebook account while visiting our fan page, a cookie containing your Facebook ID is stored on your device. Based on this cookie, Facebook can track that you have visited our fan page and how you have used it. Facebook uses this information to present you with content or advertising tailored to your interests.
If you do not want this to happen, you should log out of your Facebook account or disable the “stay logged in” feature. We also recommend that you clear the cookies on your device and close and restart your browser. This process deletes Facebook data that Facebook could use to link to you.
However, if you want to use the interactive features of our fan page, you will need to log in to Facebook again using your Facebook login credentials. This also allows Facebook to link to you again.
Facebook does not clearly and definitively state how it uses data from visits to Facebook pages for its own purposes, to what extent activities on the Facebook page are linked to individual users, how long Facebook stores this data, or whether data from a visit to the Facebook page is shared with third parties, and we are not aware of this information. In this regard, we can only refer you, as a user of our fan page, to Facebook’s privacy policy.
The data collected about you in this context is processed by Facebook and may be transferred to countries outside the European Union.
Facebook provides a general overview of the information it collects and how it is used in its data usage guidelines. As the operator of the Facebook Fan Page, we are unable to assess the transfer and further processing of users’ personal data to third countries, such as the United States, or the potential risks this may pose to you as a user.
(3) Insight function
Facebook also provides a range of statistical data to SBS-Legal, as the fan page operator, as part of the “Insights” feature. These statistics are generated and provided by Facebook. As the operator of the fan page, we have no influence over their generation; in particular, we cannot disable this feature. Within the scope of the “Insights” feature, the following information is presented to us for the categories “Fans,” “Subscribers,” “Reached People,” and “Engaged People,” each for a selectable time period:
Page activity, such as page views, page previews, and actions on the page; Reach activity, such as “likes,” people reached, and recommendations; Post activity, such as post interactions, video views, comments, and content shared.
In addition, we receive statistical information about the Facebook groups linked to our fan page. In accordance with Facebook’s Terms of Service, which each user has agreed to when creating a Facebook profile, we may also identify subscribers and fans of the page and view their profiles and other information they have shared.
Facebook provides more information on this at the following link:
http://de-de.facebook.com/help/pages/insights.
PHYCOMANIA uses this data, which is available in aggregated form, to make posts and activities on the Fanpage more appealing to users, such as for planning the content and timing of posts. The legal basis for this data processing is Article 6(1)(f) of the GDPR, namely our legitimate interest in optimizing our services.
(4) Storage period
We store the information transmitted by Facebook for no longer than is necessary, unless you request that it be deleted or anonymized.
If you no longer wish to have your data processed as described here in the future, please disconnect your user profile from our fan page by using the “Unlike this page” and/or “Unfollow this page” options.
(5) Your rights as a data subject
We recommend that you direct any requests for information or other questions regarding your rights listed at the end of this privacy policy directly to Facebook, as only Facebook has full access to user data.
